Illinois Gun Ban Appealed to Supreme Court

The high court previously rejected a request for an injunction.

The Supreme Court has received a request for an emergency injunction from a gun rights group against an Illinois ban on assault weapons and high-capacity magazines. In the request, the group stated that the ban is “fundamentally at odds with a number” of precedents from the Supreme Court.

In May, the plaintiffs requested that the Supreme Court place an injunction on the ban to keep it from going into effect, but the Supreme Court denied that request. The lawsuit made its way to the Seventh Circuit U.S. Court of Appeals, which narrowly ruled that the law was constitutional. That court stated in the November 2 decision that the rifles “are much more like machine guns and military-grade weaponry than they are like the many different types of firearms that are used for individual self-defense.”
